The employer has a duty to not only provide a safe working environment and to prevent injury to employees, but also to take steps to prevent employees suffering bullying or harassment either by the employer or by a co-worker.
Most gainful employment can involve a certain degree of stress. There is often pressure to perform to an acceptable standard and pressure to meet deadlines and to work efficiently and effectively either individually or within a team.
In certain circumstances however, the conduct of the employer or of a co-worker may breach what is legally acceptable in the employment relationship and where this results in an employee suffering a recognised psychiatric injury, a claim for personal injury can arise.
